Welcome to ModernArtCam. By accessing this website or purchasing artwork, prints, or services from ModernArtCam LLC (“we,” “us,” or “our”), you agree to the following Terms & Conditions. Please read them carefully.

1. Ownership & Intellectual Property

All artwork, images, text, designs, and content displayed on this website are the exclusive property of ModernArtCam LLC, unless otherwise stated. This includes original artworks, limited edition prints, architectural wall coverings, digital images, and written material.

No artwork or content may be copied, reproduced, distributed, stored, or used in any form without prior written permission from ModernArtCam LLC.

Purchase of artwork does not transfer copyright or reproduction rights.

2. Artwork & Product Descriptions

We make every effort to accurately represent the colors, textures, and details of each artwork. However, due to variations in screens, lighting, and display settings, the appearance of artwork may differ slightly from what you see on your device.

All dimensions, materials, and edition details are listed in good faith and may contain minor variations inherent to handmade or limited edition works.

3. Original Artwork Sales

All original artworks are unique and one-of-a-kind unless explicitly stated otherwise.

Original artwork sales are final, unless the artwork arrives damaged (see Shipping & Damage section below).

4. Limited Edition Prints

Limited edition prints are produced in strictly controlled quantities. Edition size, numbering, and signing (if applicable) are specified in each product listing.

Once an edition is sold out, no additional prints of that artwork will be produced in the same format.

Limited edition print sales are final, except in cases of damage during shipping.

5. Architectural Wall Coverings & Large-Scale Works

Architectural wall coverings and large-format installations may be custom-sized, scaled, or adapted for specific projects.

Due to the custom nature of these works:

  • All wall covering orders are final once production begins

  • Installation services, if provided, are governed by separate agreements

  • Color, scale, and texture may vary slightly based on substrate, lighting, and installation method

Clients are responsible for verifying measurements and site conditions prior to production.

6. Pricing & Payment

All prices are listed in U.S. dollars unless otherwise stated.

Payment must be received in full before artwork is released, produced, or shipped, unless alternative terms are agreed upon in writing.

We reserve the right to update pricing at any time without prior notice.

7. Shipping & Delivery

Shipping costs, methods, and timelines are listed at checkout or provided by invoice.

Buyers are responsible for providing accurate shipping information. ModernArtCam LLC is not responsible for delays caused by carriers, customs, or incorrect address details.

8. Damage in Transit

If artwork arrives damaged, you must notify us within 48 hours of delivery, including clear photographic documentation of:

  • The artwork

  • The packaging

  • The shipping label

Claims submitted after this window may not be eligible for replacement or refund.

9. Returns & Refunds

Due to the nature of fine art:

  • All original artwork sales are final

  • All limited edition print sales are final

  • Custom and architectural works are non-refundable

Refunds or replacements are considered only in cases of verified damage during shipping.

10. Resale & Display

Purchased artwork may be displayed in private or commercial settings.

Artwork may not be reproduced, licensed, or resold commercially (including use in merchandise, advertising, or digital products) without written permission from ModernArtCam LLC.

11. Website Use

You agree not to misuse this website, including attempting to access restricted areas, scrape content, or interfere with site functionality.

We reserve the right to restrict access or terminate use if these terms are violated.

12. Limitation of Liability

ModernArtCam LLC is not liable for indirect, incidental, or consequential damages arising from the use of this website or the purchase of artwork, to the fullest extent permitted by law.

13. Governing Law

These Terms & Conditions are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
